Mum loses £650,000 disability case after 'most incriminating photo of all time'

Mum loses £650,000 disability case after 'most incriminating photo of all time'

She claimed she couldn't work for over five years due to constant back and neck pain

A mum who tried to claim almost £650,000 for injuries she suffered in a car crash lost her case after an incredibly incriminating photo surfaced.

36-year-old Kamila Grabska claimed she was left with a 'disabling' condition after her car was hit from behind in February 2017.

Launching a lawsuit on the grounds that she couldn't work for over five years, play with her children or do chores around the house as she suffered from constant pain in her neck and back, Grabska attempted to claim €760,383 (£649,967) for her injuries.

However, the Irish High Court in Limerick was shown a photo which sunk her case as on 8 January, 2018 she had been pictured winning a Christmas tree throwing contest.

Yes, really.

She claimed she was in serious and constant pain due to her injuries, but she was able to win a Christmas tree throwing competition.

The mum-of-two argued that while she looked happy in the pictures, which included an image of her actually hurling a Christmas tree, she was actually still suffering from pain.

However, Judge Carmel Stewart threw out Grabska's case and said the 'very graphic picture' of the mother throwing a Christmas tree had helped her reach the decision.

According to the Irish Independent, she said: "It is a very large, natural Christmas tree and it is being thrown by her in a very agile movement.

"I’m afraid I cannot but conclude the claims were entirely exaggerated. On that basis, I propose to dismiss the claim."

The mum had told doctors that her injuries were so severe after the car crash that she couldn't lift a heavy bag without feeling pain.

The judge's decision to throw out her case was helped by the pictures of her throwing a Christmas tree.

Quitting her job after the crash and receiving disability payments, court documents claimed that her loss of earnings due to being unable to work amounted to €500,000 (£427,340).

She also said there were days when she could not even get out of bed due to the agonising pain, and that her husband would have to bring her medication where she lay.

The court heard that just a few days after she was pictured winning the Christmas tree throwing competition she was telling doctors about the terrible pain she was in.

A video of her training her dog in a park for over an hour was also shown to the court.

Grabska denied the idea that she faked her injuries and said she was 'simply trying to live a normal life', but the judge said her actions were 'completely at odds' with her claims over the injuries she suffered in the car crash.
